USCIS recently announced that certain immigrants would now on require to attend an in-person interview before the USCIS finally conveys its decision of granting permanent residency to the respective applicant.


This change complies with Executive Order 13780, “Protecting the Nation from Foreign Terrorist Entry into the United States,” and is part of the agency’s comprehensive strategy to further improve the detection and prevention of fraud and further enhance the integrity of the immigration system.

The rule goes effective from Oct. 1, 2017. USCIS will begin to phase-in interviews for the following categories of immigrant applicants:
• Adjustment of status applications based on employment (Form I-485, Application to Register Permanent Residence or Adjust Status).
• Refugee/asylee relative petitions (Form I-730, Refugee/Asylee Relative Petition) for beneficiaries who are in the United States and are petitioning to join a principal asylee/refugee applicant.



Interviews have always been a part of the immigration process, and, in the past, USCIS conducted them for all the cases as a standard policy. However, decades ago, USCIS started routinely waiving in-person interviews for employment-based cases at its field offices to avoid duplicating the efforts of USCIS Service Centers, which vetted the cases. Under the new policy, USCIS will not grant any such waivers.


USCIS and all other federal partners are working collaboratively to develop more robust screening and vetting procedures for individuals who apply to seek immigration benefits to permanently reside in the United States.”
Conducting in-person interviews will provide the USCIS officers with an opportunity to verify the information provided in an individual’s application, to discover new information that may be relevant to the adjudication process, and to determine the credibility of the individual seeking permanent residence in the United States.


USCIS has not shared any details with regards to the place or location where these

interviews will be conducted, how the applicant will be notified about the schedule of the interview, and any other requirements. Our Law firm is following the details and will update once further details are made available by the agency.
