On Sep 21, 2018, DHS informed the federal court, that they expect the proposed H4 EAD withdrawal rule to be published for public comments within 3 months i.e. approximately around the first week of January 2019 or late December 2018.
DHS also informed that it has completed their portion of the rule-making work and has sent it to the USCIS for their review. Upon receiving the final updates from the USCIS the rule will be immediately sent for OMB review (public comments period of 30 to 90 days).
The latest court filing confirms that the H4 EAD withdrawal rule has not yet reached the office of management and budget. The DHS has updated the court they need more time to send the rule draft regulation to the office of management and budget.
SAVE Jobs USA has recently filed the motion in connection with lawsuit originally filed on April 23, 2015 against the DHS with the court and has requested oral hearing. After 10 days, DHS filed response requesting the court to hold the case as it is as they plan to submit the rule to OMB within 3 months. The court has not provided any response on the same yet.
